compromise and accordingly signed
the consent terms dated 5th
October, 2007 by the authorized
signatory of the petitioner and
Chairman of the respondent
company. The respective
advocates have also signed the
same. There is no dispute about
the identification of parties as
well as signature. The consent
terms marked as "X" is taken on

record. The pay order of
Rs.3,75,000/- (Rupees three lacs
seventy five thousand only) as
per the consent terms, has been
handed over in the Court to the
petitioner’s representative.

2. By order dated 13th January,
2004 though ordered, there was no
advertisement of the petition.
The respondent company appeared
even at that time.

3. As the parties have settled
the matter, the present Company
petition is disposed of in view
of the Consent terms.

4. The petition is disposed of,
accordingly, with liberty.
