. This chamber summons is taken out by the
plaintiffs for bringing heirs of deceased defendant
10(b) on record. There is a delay of 398 days in
taking out this chamber summons.

2. On 20/3/07 this court had directed that notice
be issued to the heirs of defendant 10(b). The
learned counsel for the plaintiffs says that
accordingly the proposed heirs of defendant 10(b)
have been served. Affidavit of service has been
filed by one Suresh R. Shinde, Clerk in the office
of advocate for the plaintiffs. To the affidavit
are annexed postal acknowledgement. The service
report indicates that the said defendants have been
served, however, none is representing them.
3. In the circumstances the chamber summons is
made absolute in terms of prayer clauses (a), (b)
and (c). Amendment to be carried within four
weeks. Chamber Summons is disposed of.
