Chandrashekhar Ramchandra Pawar has tendered to this
Court an undertaking whereby he has undertaken to pay
the arrears of maintenance due from the
applicant-husband to the respondent-wife within six
months as also the arrears of society charges of the
matrimonial home from June, 2007 to September, 2007
within one week. The undertaking is accepted and is
taken on record and marked "X" for identification.

The undertaking further states that the monthly
maintenance and society charges may be deducted from
the pension of the applicant-husband.

2.We direct that the applicant-husband shall pay
to the respondent-wife Rs. 5000/- per month which
amount would include the monthly maintenance and
society charges in respect of the flat in addition to
the maintenance of the respondent-wife. For the
aforesaid purpose we direct the Commissioner of
Police, Mumbai to take necessary steps to deduct
Rs.5000/- from the pension of the applicant-husband
Shri Ramchandra Hari Pawar, who is retired Police
Sub-Inspector, with effect from October, 2007 and
ensure payment of said sum to the wife of said
Ramchandra Hari Pawar i.e. Mrs. Vimal Ramchandra
Pawar by crediting it in her Saving Account with the
post office until further orders. The learned
Counsel for respondent-wife submits that the details
of the post office savings account will be furnished
to the Commissioner of Police, Mumbai along with the
copy of this order. It is made clear that the
respondent-wife would continue to reside in the

matrimonial flat in question without any disturbance
or obstruction from any one.

3.Civil Application No.167/2007 is disposed of
on the above terms.

4.Civil Application No.204/2007 be heard along
with the appeal.
