1. This is an application for parole. The
petitioner-prisoner is suffering from heart problems and
he had a heart-attack. He wants to take treatment in a
Military Hospital. We had directed the Advocate for the
petitioner to verify as to whether private persons are
treated in the Military Hospital. Now the Advocate for
the petitioner makes a statement that private persons are
treated in the Military Hospital. The learned Addl.
Public Prosecutor tries to contend that if required, the
petitioner can be given treatment in Sassoon Hospital.
But looking to the ailment, the petitioner can be given
freedom of choosing the hospital of his choice.

2. Accordingly, the petitioner be released on parole on
usual terms and conditions. The petition is disposed of.
3. Office to communicate this order to the concerned jail authorities.
