1. In both these matters, the learned Advocates
for the Petitioners along with the Petitioners, as
well as the Advocates for the Respondent Nos. 4 and
5 along with the said Respondents are present in the
Court and submit that the parties have arrived at
amicable settlement and place on record Minutes of
Consent Order under the signature of the Advocate
for the Petitioners as well as Advocate for the
Respondents, viz. The State of Maharashtra, Deputy
Director of Education and the private Respondents.
The Minutes of Order filed in both the Petitions are
taken on record and marked Exhibit ’X’ and ’X-1’
respectively, for identification. Advocate for the
Petitioners as well as for the private Respondents
have further submitted that in terms of the amicable
settlement, arrived at, no financial liability is
cast upon the State Government or the Zilla
Parishad. The Schools in question are un-aided and
the payment of salary of the Petitioners is agreed
to be paid under the Minutes of Consent Order should
not be a burden in any manner either upon the
Government or upon the Zilla Parishad. As far as
the Zilla Parishad Officer is concerned, its role
would be only to determine the arrears of salary
payable to the Petitioners. Apart from deciding the

said matter, there would be no role for the
Education Officer in the entire amicable settlement
arrived at between the parties.
2. In the circumstances, therefore the amicable
settlement arrived at in terms of the Minutes of
Consent Order placed on record is accepted and the
Petitions are disposed of in accordance with the
said Minutes of Consent Order. There shall be no
order as to costs. Rule made absolute in above
terms in both the Petitions.
