1.Learned A.P.P. states that on 3rd September,
2005, order has already been passed. He states that a
copy of the order will be given to the petitioner
immediately. Mr. Kanugo submits that as soon as he
gets a copy of the order, the petitioner will file a
fresh Petition, challenging the said order. Hence he
wishes to withdraw this Petition with liberty to file
fresh Petition.

dated 3rd September 2005, passed by the Assistant
Commissioner of Police, Goregaon Division. The order
passed by this Court on 22nd August 2005 will remain in
operation for a period of three weeks from the date of
receipt of the order by the petitioner. All contentions
of both sides are kept open.
