.The petitioner has prayed that the conditions
of furnishing solvent surety of Rs. 4,28,000/- as
imposed by the respondent No.1 in his order dated
23/5/2005 be waived, as the petitioner is unable to
furnish the same. The learned A.P.P, Mr. More has
produced in this Court a letter dated 25/8/2005 issued
by the Regional Transport Officer, Nasik to Sr.
Inspector of Police, Panchavanti Police Station, Nasik
stating that the value of the vehicle in question is
about Rs. 2,20,000/-.The letter is taken on record and

marked Exh. "A". The learned Counsel for the
petitioner states that the petitioner is not even in a

position to furnish the security for Rs. 2,20,000/-
also. He states that he may be permitted to approach
the Additional District Collector, Nasik, who has passed
the order dated 23.5.2000 for modification of this
order. We see no reason why such permission should not
be granted. The petitioner may approach Additional
District Collector, Nasik for modification of the order
dated 23/5/2000. The Additional District Collector,
Nasik shall deal with the application of the petitioner
independently and in accordance with law. We make it
clear that we have not expressed any opinion on the
merits of the petitioner’s case and the Additional
District Collector is free to pass such order as he
deems fit. The petition is disposed of.
