Reply to the application for condonation of delay has been filed. On 30th May, 2019, the respondent seeks time to take the instruction as to whether prosecution complaint in the said matter has been filed or not. He is unable to get the instruction. He seeks more time to take the instruction.
As far as condontion of delay application is concerned, reply as been filed. There is a controversy remains as to whether the appellant was served with the impugned order or not. Counsel for the appellant states that no copy was served and whenthe appellant came to know

about the said order, the application for certified copy was filed. According to the appellant, the appeal is within the time.
We have to check up the record of the Adjudicating Authority. The Adjudication Authority’s registry is directed to provide us proof/record in order to show as to whether the impugned order was served/delivered.
Let the same be done within 10 days. Registry is also directed to
take necessary steps in this regard immediately.
