Fresh application has been filed for initiating the contempt proceedings against the respondent as the order dated 11^th January, 2019 has not been complied by the respondent.

Learned counsel for the respondent states that an appeal has been filed before the Hon’ble Patna High Court. Learned counsel for the appellant states that the for the last more than six months have expired, the appeal is not proceeded further by the respondent and as of today, there is no stay of operation of the order dated 11^th January, 2019, therefore, the respondent is now to comply the order dated 11^th January, 2019. Counsel for the appellants states that despite of offering to deposit the use and occupation charges as per same order, the respondent is not ready to accept the same. One final opportunity is granted to the respondent to comply the order within two weeks, otherwise adverse inference shall be drawn against the I.O.

In case the order is not complied in the absence of any stay order, the I.O. shall remain present before this Tribunal in the next date of hearing.

Issue notice in the contempt application for the next date. Reply be filed by the respondent within four weeks.
