The interim order in the above-said matter was passed on 28th June, 2017. Reply to the application has not been filed by the respondent. Let the same be filed on or before the next date as last opportunity. List this application for same date. Fresh application has been filed on 07th July, 2017. Issue notice to Mr. S.A. Saud, learned counsel appearing on behalf of the respondent seeks time to file the reply. Ms. Manali Singhal submits that the detail of the properties are mentioned in para 3 of the FPA-PMLA-1666/MUM/2017 Page 1 of 2
application in which the fresh interim order is sought in view of the additional notice under Section 8(4) is issued in the 4th week of June, 2017. In para 3 where the detail of the properties are mentioned, the rent received from the tenants are also mention in the last column. Ms. Manali Singhal, learned counsel for the appellant submits that in support of the same she would be filing the copies of the documents which are in their possession including the rent agreements. The advance copy will also be served to the learned counsel for the respondent within one week. We have calculated the alleged rent mentioned in the application in para 3 of the application about 20-21 thousand in the interest of justice and in order to strike the balance between the parties. At present, they are fix the use and occupation charges to be deposited by the appellant at for sum of Rs. 21,000/without prejudice the final decision of the appeal or the order is modified after the verification of the respondent. The said amount shall be deposited on or before the next date with the respondent from the date of confirmation of the order. Thereafter, the said amount shall keep on deposit every month of 7th day on calendar. Subject to the said deposit, no coercive action shall be taken by the respondent. In view of the additional notice under Section 8(4) in the 4th week of June, 2017.
