The learned counsel for the appellant has submitted that the Hon’ble Supreme Court has not passed any stay order, not to proceed with the present appeal. In the affidavit it is mainly stated that SLP is coming up on 16th November, 2016. Thus there is no impediment to hear the appeal.
Pertaining to the interim order passed on 7th July, 2014, the learned counsel for the appellant submits that the premises in question are in custody of Enforcement Directorate. Hence, he may not be insisted upon to make the payment to the respondent. No such application for modification of the order dated 7th July, 2014 has been filed, therefore, the request of the appellant cannot be accepted. The learned counsel at this

stage seeks some time to move appropriate application for modification of the said order mainly on the reason that the appellant is not enjoying the
property. Let the same be done on or before the next date of hearing.
