After passing the last order, the application has been filed by the appellant. According to the appellant, the appellant apprehend that the respondent may take the possession of the property newly residential unit bearing Apartment No. 902, Tower-17LH in Lanco Hills, Manikonda, Hyderabad. Learned Counsel Mr. S. A. Saud appearing on behalf of the respondent has raised the objection with regard to the statement made in the Para 6 and 8 of the application. The Learned Counsel for the appellant apologized for the same and wishes to withdraw the statements in the said Paras and submits that this Tribunal may decide the application as per merits of the application. Mr. S. A. Saud, learned Counsel for the respondent submits that his client will verify the position

at the site with regard to the actual amount of use and occupation charges. After hearing for some time, we are of the view that, in the meanwhile the appellant shall deposit Rs. 25,000/- per month from the date of impugned order within the period of two weeks from today with the respondent. The appellant undertakes to keep making the deposits of the said amount during the pendency of the appeal. Liberty is given to the Learned Counsel for the respondent, in case the affidavit with the evidence is filed. To move the application for modification of the order, if so required after verification of the actual rent of the flat. The appellant undertake not to dispose of or create any third party rights and interest in the said flat directly or indirectly. Subject to compliance with the order as above, there shall not be any coercive action taken by the respondent under Section 8(4) pertaining to the attached property.
