With reference to the last order dated 7^th October 2016, the learned counsel appearing on behalf of the respondent submits that the respondent is ready appear to take possession of the property in question i.e. 401, Park Avenue Apartment, Shrikrishna Puri Patna. It appears from the last order that such statement was made by the counsel for the appellant Shri Dharam Dev who stated that in case the respondent is insisting on payment of said amount as fixed earlier, appellant is not in a position to pay the same and is ready to handover possession of the said

property to the respondent. As the respondent is ready to take the possession the appropriate steps be taken by both sides. The appellant is directed to handover vacant peaceful possession of the property to the respondent who may accept the possession.

With regard to other property F.No. 4-D, Raj Laxami Enclave, Boring Road, Patna, the learned counsel for the respondent states that the amount as fixed by this Tribunal towards the rent/charges is not being received on time and sometime not received at all. He would be moving the appropriate application giving the further details so as the appropriate order can be passed. List the application as may be filed on or before the next date of hearing.
