The Writ Petition has been filed under Article 226 of the Constitution

of India seeking the following relief:-

“…to Issue a Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent police in interfering with the civil dispute relating to the petitioners land and aiding/abetting the private respondents as illegal arbitrary and without jurisdiction Consequently direct the respondent police not to interfere in any manner in the civil dispute relating to the subject property except in accordance with due process of law Further direct the respondent police not to extend any support or assistance to the private respondents in carrying out illegal construction over the subject property Direct the private respondents not to proceed with any illegal construction and not to change the nature of the subject property Pass….”

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

Ms. Talari Rajeswari, learned counsel for the petitioner, submits that the respondent police are interfering in the civil disputes relating to the petitioner’s land and are aiding the private respondents.

Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that, as per the records of Kanaganapalli Police Station, no representation or complaint has been received either from the petitioner or from the unofficial respondents herein with regard to the alleged disputes. Therefore, the allegation that the respondent police are

interfering in a civil dispute or calling the petitioner to the police station without any lawful basis is baseless.

Considering the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of, directing the respondent police not to interfere henceforth in the civil disputes pending between the petitioner and respondent No.4.
