Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not paying the admitted due amounts Rs 4,25,648/-, Rs 4,22,046/-, Rs 4,55,758/- and Rs 4,42,043/- respectively totaling Rs 17,45,495/- (Seventeen lakhs Forty Five thousand four hundred and ninety five) payable to petitioner for the 4 works executed for 8th respondent by the petitioner, under their respective agreements Bearing Nos 37/2025-26 (dated 03- 06-2025),38/2025-26 (dated 03-06-2025),52/2025-26 (dated 23-09- 2025) and 53/2025-26 (dated 23-092025), despite finalizing the bills, as illegal, arbitrary, unconstitutional and consequently direct the respondents herein to immediately pay the total due amounts of Rs 4,25,648/-, Rs 4,22,046/-, Rs 4,55,758/- and Rs 4,42,043/respectively totaling Rs 17,45,495/- (Seventeen lakhs Forty Five thousand four hundred and ninety five) payable to petitioner in relation to the above 4 works executed for 8TH respondent under the said agreements with an interest @ 12 PERCENT per annum and pass

The learned counsel for the petitioner submits that the petitioner was entrusted with the works i.e., (i) Providing and Laying 200mm OD HDPE class 10kg/cm2 distribution Pipe line from Amma Vari Chettu (Vepu Chettu) to Kapau Kalyana Mandapam beside Thavva Kaluva at 14^th ward in Bapatla Municipality, vide Agreement No.37/2025-26, dated 03.06.2025, (ii) Providing and Laying of 160mm OD HDPE class 100-8kg/cm2 distribution Pipe line from Kapu Kalayana Mandapam Hanumantha Rao Colony Arch 14^th ward in Bapatla Municipality, vide Agreement No.38/2025-26, dated 03.06.2025 (iii) Providing and Laying of 200mm OD HDPE class 100-8kg/cm2 distribution Pipe line from Ch.Vinay Chowdary house to Thotakura Venkateswarlu House at 14^th ward in Bapatla Municipality, vide Agreement No.52/2025-26, dated 23.09.2025 and (iv) Providing and Laying of 200mm OD HDPE class 100-8kg/cm2 distribution Pipe line from Thotakura Venkateswarlu House to Royal Medicals at 14^th ward in Bapatla Municipality, vide Agreement No.53/2025-26, dated 23.09.2025.

It is submitted that the petitioner had completed the works entrusted to her and that the competent authority of the respondents had also approved the payments due and payable to the petitioner. The respondents have also recorded the progress of the works and the amounts due and payable to the petitioner in the M-Book.

Heard the submissions of the learned counsel for the petitioner, the learned Government Pleader for Municipal Administration and Urban Development Department, Smt.V.Sireesha Rani, learned Standing Counsel for the respondent Municipality and the learned Assistant Government Pleader for Finance and Planning.

During the course of hearing, the learned Standing Counsel appearing for the respondent Municipality, on written instructions, submits that the bills were approved for clearance, that funds were also released by the Government for clearing the outstanding bills of the contractors, and that the amounts due and payable to the petitioner have been duly admitted. It is submitted that further funds are awaited and that, soon after the release of the funds, the bills due and payable to the petitioner shall be cleared.

Recording the submissions, this writ petition is disposed of at the admission stage, directing the respondents to verify and release the payments due and payable to the petitioner as expeditiously as possible, preferably within a period of eight (08) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
