The Writ Petition has been filed under Article 226 of the Constitution

of India seeking the following relief:-

“…to issue a Writ or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent in compelling the Writ Petitioner to settle the civil dispute with the 4th Respondent in respect of the land admeasuring 420 Sq yards situated in Sy No 17/2 of Mulapadu Village Ibrahimpatnam Mandal NTR District as illegal arbitrary colourable exercise of power violation of Article 14 21 and 300 A of Constitution of India and consequently direct the 3rd Respondent not to interfere in the civil disputes between the Writ Petitioner and 4th Respondent in respect of the land admeasuring 420 Sq yards situated in Sy No 17/2 of Mulapadu Village Ibrahimpatnam Mandal NTR District and pass….”

2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader.

Ms. T.Urmila Rani Patro, the learned counsel for the petitioner submits that respondent No.3 has been compelling the petitioner to settle the civil disputes with respondent No.4 in respect of land admeasuring Ac.420 square yards situated in Sy.No.17/2 of Mulapadu Village, Ibrahimpatnam Mandal, NTR District, and seeks a direction to respondent No.3 not to interfere in the said civil disputes.

Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that, based on the complaint lodged by respondent No.4, a case in Crime No.129 of 2026 has been registered against the petitioner for the alleged offences punishable under Sections 329(4),

324(4), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’), and that, in the course of investigation, the Investigating Officer has served a notice under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) on the petitioner. The investigation is in progress.

Mr. Venkat Chalasani, the learned counsel for respondent No.4 submits, on similar lines, as stated by the learned Assistant Government Pleader, that the investigation is in progress.

On the other hand, the learned counsel for the petitioner contends that the entire transaction is civil in nature and that the Investigating Officer has no jurisdiction to proceed further in the matter.

In this regard, it is to be noted that the petitioner has an alternative efficacious remedy by way of filing an appropriate petition seeking quashment of the proceedings, if so advised, in case it is contended that the dispute between the petitioner and respondent No.4 is purely civil in nature.

Considering the entire facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader as well as the learned counsel for respondent No.4, the Writ Petition is disposed of, directing the respondent No.3 not to interfere in the civil disputes pending between the petitioner and respondent No.4, without following due process of law.
