This Writ Petition is filed under Article 226 of the Constitution of India seeking the following prayer;

“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent No.2 in not considering the petitioner representation dated 02-02-2026 or conducting a survey and fixing boundaries to the petitioners residential plots bearing No. 104 and 105 in Sy. No. 28 of Chandrababu Nagar, Dharmavaram, Sri Satya Sai District as illegal, arbitrary. violation of principles of Natural Justice and violation of Article 14, 21 and 300-A of the Constitution of India and consequently direct the Respondent No.2 to conducting a survey and fixing boundaries to the petitioners residential plots bearing No. 104 and 105 in Sy. No. 28 of Chandrababu Nagar, Dharmavaram, Sri Satya Sai District and pass….”

Heard learned counsel for the petitioner and the learned counsel for the respondents. Perused the record.

Grievance of the petitioner herein is that Respondent No.2 has not passed any orders on the representation dated 02.02.2026 submitted by him.

Learned counsel for the petitioner submits that earlier, the petitioner filed Writ Petition No.24652 of 2023 aggrieved by the action of the respondent authorities in laying a road in the subject plots without issuing any notice to the petitioner, and consequently sought a direction to the respondents not to

interfere with, or lay a road, in the petitioner’s residential plots bearing Nos.104 and 105 in Sy.No.28 of Dharmavaram, Sri Satya Sai District, without following due process of law. By an order dated 07.02.2025, a Coordinate Bench of this Court directed the respondents not to interfere with the petitioner’s possession over the subject property without following due process of law.

Learned counsel for the respondents submits that the respondents have not interfered with the subject property pertaining to the petitioner, and the present Writ Petition has been filed only in view of the existing land dispute, and the petitioner seeks the indulgence of the respondent authorities to conduct a survey of the aforesaid property.

Irrespective of the same, since a representation has been made by the petitioner, it is the duty of the respondent authorities to pass appropriate orders on the said representation. 7. In view of the aforesaid facts and circumstances, the respondent authorities are directed to pass appropriate orders on the representation dated 02.02.2026 made by the petitioner within a period of four (4) weeks from the date of receipt of a copy of this Order.
