The present writ petition is filed seeking the following relief:

<….to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the inaction of the Respondents in paying the gratuity Rs.6,66,881/- along with Commutation an amount of Rs.7,09,339/- Commutation with 10% from date of retirement to the Petitioner i.e 30-06-2015 as illegal, arbitrary and also against the Principles of Natural Justice consequently to direct the Respondents to forthwith release the gratuity Rs.6,66,881/- along with Commutation an amount of Rs.7,09,339/- to the Petitioner….=

Heard the learned counsel for the petitioner, learned Assistant Government Pleader appearing for respondent Nos.1 to 4 and Sri Y.Koteswara Rao, the learned Standing Counsel appearing for respondent Nos.5 and 6.

Sri Y.Koteswara Rao, the learned Standing Counsel appearing for respondent Nos.5 and 6, based on the instructions furnished by the Mandal Parishad Development Officer, Mandal Parishad, Akiveedu, submitted that proposals for gratuity and commutation amounts of Rs.6,66,881/and Rs.7,09,339/-

respectively have been submitted to the Chief Executive Officer, Zilla Parishad, West Godavari District, Eluru, for sanction and in turn, the Chief Executive Officer has forwarded the proposals to the Commissioner, Panchayat Raj and Rural Development, on 21.06.2023 for release of funds.

Considering the said submissions and without going into the merits of the case, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for release of the retiremental benefits and commutation within a period of three (3) months from the date of receipt of a copy of this order. With regard to interest, the respondents shall also consider the same as per the existing rules for delay in payment. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall
