Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order or direction mostly one which is in the nature of a Writ of Mandamus declaring the action of the Respondents in non-payment of amounts due to the Petitioner even after finalizing the bills, payable in relation to the works executed in pursuance of works, i.e. (1) Urgent Repairs to Metrevu - Perupalem Beach Road from Km 0.0000 to 3.900 in West Godavari District (WGMD 212) due for an amount of Rs .17,41,491/- (2) Urgent Repairs to Narsapuram - Karimsettivaripalem Road from Km 0.0000 to 10.000 in West Godavari District due for an amount of Rs.20,51,104/as illegal, arbitrary, unjust, unfair, unreasonable and unconstitutional and consequently direct the Respondents to make the payment of amounts due to the Petitioner in respect of above execution of works forthwith and pass such other order or orders.

The present writ petition is filed aggrieved by the action of the respondents in not paying the bill amounts despite execution of the work.

Learned counsel for the petitioner would submit that pending consideration of the Writ Petition, the respondent authorities have paid amounts due to the petitioner and nothing survives in the Writ Petition for adjudication. Hence, prayed to close the Writ Petition.
