“…to issue a writ, order or direction, more particularly a writ in the nature of Writ of MANDAMUS declaring the inaction of the respondents 3 to 5 in not undertaking the survey relating to the land bearing Sy.No.131/C at Boppudi Village, Chilakaluripet Mandal, Palnadu District, as bad, illegal, arbitrary, opposed to law and pass…”

After acquisition of land from the petitioners by the National Highway Authority of India, small extent of land were left with the petitioners. But for acquisition of the land identifying the fragments of the land has become difficult. The petitioners have made an application to respondents-revenue authorities to conduct a survey and mark their property for utilization. The said representation was not considered by the respondent revenue authorities. Hence, this Writ Petition is filed seeking a direction the respondent authorities to conduct the survey.

Learned Assistant Government Pleader would submit that on receipt of such representation from the petitioners, the Tahsildar has forwarded the representation dated 19.02.2025 to the Mandal Surveyor to conduct the survey. As per the Tahsildar direction, the Mandal Surveyor undertook the survey and furnished the report to the Tahsildar.

Learned counsel for the petitioners submits that as directed by the Tahsildar, the Mandal Surveyor has not conducted any survey, even assuming that he has conducted the survey, the copy of the survey report has not been provided to the petitioners herein.

Learned counsel for the petitioners further contends that the respondents have not conducted the survey. If a survey had been conducted a report would have been provided. Therefore the petitioners’ counsel requests this Court either provide the survey report for further legal course open to the petitioners or direct the revenue authorities to conduct a survey as per the representation.

Learned Assistant Government Pleader for Revenue submits that survey was already conducted as directed by the Tahsildar.

Considering the submissions made and in view of such representation made by the learned Assistant Government Pleader for Revenue the Tahsildar is directed to provide a copy of the survey report to the petitioners herein within a period of one (01) week from the date of receipt a copy of this order, failing which, the Tahsildar is further directed to conduct a survey after dealing with the notice to the Writ Petitioners.
