DR.No.08/2023-2024 and DR.No.9/2023-2024 dated 12.03.2024 respectively as arbitrary, illegal, contrary to Law and against the Principles of Natural Justice and against the Norms of the Public Policy and to issue consequential direction directing the respondent authorities to release the amounts payable to the petitioners with an interest at 18percent per annum,

Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondent authorities to release an amount of Rs.5,88,855/- and Rs. 6,08,231/- to the petitioners for the execution of works, vide Agreement No’s.DR.No.08/2023-2024 and DR.No.9/2023-2024 dated 12.03.2024, respectively, pending disposal of the above writ petition

The Court made the following order:

The grievance of the petitioner is that the respondent authorities are not releasing an amount of RS.5,88,855/- and Rs.6,08,231/- to him for the execution of works vide Agreement Nos.DR.No.08/2023-24 and DR No.9/2023-2024 dated 12.03.2024 respectively.

Heard Ms.Akhila, learned counsel, representing Sri G.Venkat Sailendra, learned counsel for the petitioner, learned Assistant Government Pleader for Roads and Buildings Department and learned Assistant Government Pleader for Finance Department.

Learned counsel for the petitioner, in elaboration to what has been stated in the affidavit, contended that despite the completion of the contractual work and the finalization of the bills payable to the petitioner, the respondent authorities have failed to release the amounts. Hence, prayed to pass appropriate orders protecting the interest of the petitioner.

Learned Assistant Government Pleader for the Roads and Buildings Department, while placing on record the letter addressed by the Executive Engineer, NH Division, Vijayawada, vide Lr. No. Court Cases/WP No.15770 of 2026/A1/2026 dated 17.06.2026, submitted that a request for allocation of Budget/Letter of Credit (LOC) in respect of the subject agreements has already been addressed to the Engineer-in-Chief (R&B), NH & CRF, Vijayawada. He further submitted that, upon receipt of the LOC, the work bills would be processed immediately through the NIDHI portal by the Pay &

Accounts Officer (PAO), W.A., Vijayawada, to facilitate payment to the petitioner at the earliest. Therefore, it is urgently requested that the necessary sanctions be accorded and the Letter of Credit (LOC) be released for the total admitted amounts of Rs.5,88,855/- and Rs.6,08,231/- at the earliest. He sought three months' time for release of the admitted amounts payable to the petitioner.

To the said submission, learned counsel for the petitioner reported no objection and prayed to pass appropriate orders in that regard.

In view of the facts and circumstances of the case and taking the submissions of learned counsel for the parties into consideration, as the authorities have expressed their intention to pay the admitted amount to the petitioner, there is no purpose in keeping this Writ Petition pending. As such, this Court is inclined to dispose of the same, with the consent of both the parties, at the admission stage itself, by passing the following order:

“The respondent authorities are directed to pay an amount of Rs.5,88,855/- (Rupees Five Lakhs Eighty Eight Thousand Eight Hundred and Fifty Five only) and Rs.6,08,231/- (Rupees Six Lakhs Eight Thousand Two Hundred and Thirty One only) to the petitioner within a period of three (3) months from the date of receipt of a copy of this order. It would be open to the petitioner to agitate its claim for interest, if any, payable by the respondents in an appropriate forum, if so advised.”
