This Court made the following ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India by the Petitioners for the following relief:

“to issue a Writ of Mandamus, or any other appropriate writ, order or direction, declaring the action of the 2nd respondent in not passing any orders in response to the respective proceedings in Rc.No. 11 74/E1/GGH/ELR/2025, dated 16.9.2025 and Rc.No.1648/E1/GGH/ELR/2025, dated 4.12.2025 addressed by the 3rd respondent for reinstate me into duties as Anesthesia Technician in Government General Hospital, Eluru as illegal arbitrary and violation Article 14, 19 and 21 of Constitution of India and consequently direct the respondent Nos.2and 3 to reinstate the petitioner for the post of Anesthesia Technician in Government General Hospital, Eluru forthwith paying back wages from March, 2025 and pass….”

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondents.

The grievance of the petitioner is that the respondents issued a show-cause notice in view of Crime No.324 of 2024 registered by Eluru II Town Police Station against the petitioner and his wife for the offence under Section 108 read with Section 3(5) of the Bharatiya Nyaya Sanhita. The petitioner was arrested on 10.12.2024 and was remanded to judicial custody on 11.12.2024, and was subsequently granted bail

on 17.01.2025. After his release from judicial custody, the petitioner approached the 3rd respondent seeking permission to discharge his duties. Thereafter, a show-cause notice dated 29.03.2025 was issued to the petitioner calling upon him to submit his explanation for alleged unauthorized absence with effect from 01.12.2024. The petitioner submitted his explanation on 07.04.2025. Subsequently, Crime No.324 of 2024 was quashed by this Court vide order dated 20.06.2025 in Crl.P. No.5447 of 2025. After quashing of the said crime, the petitioner submitted a representation dated 11.09.2025 to the 3^rd respondent, enclosing the relevant documents and requesting consideration of his case for permitting him to discharge his duties. Pursuant thereto, the 3^rd respondent addressed a letter dated 16.09.2025 to the 2nd respondent. However, the 2^nd respondent has not passed any orders till date. Hence, the present writ petition.

On the other hand, the learned Government Pleader appearing for the respondents submits that a show-cause notice was issued and that the petitioner has submitted his explanation dated 07.04.2025, however, the respondents have not passed any orders till date.

Considering the submissions made on either side, this Court is not inclined to go into the merits of the case. Accordingly, the writ petition is disposed of at the stage of admission, directing the

respondents, more particularly the 3^rd respondent, to consider the explanation dated 07.04.2025 submitted by the petitioner and pass appropriate orders thereon, also by taking into consideration of the order passed by this Court dated 20.06.2025 in Crl.P. No.5447 of 2025. The said exercise shall be completed within a period of one (01) month

from the date of receipt of a copy of this order. No costs.

As a sequel, interlocutory applications if any pending, shall stand closed.
