The Petitioner joined service on 01.02.1984 as a Supervisor and retired on superannuation on 28.02.2023 as Deputy Executive Engineer, APSHCL, Jaggaiahpeta Sub-Division, under the Revised Pay Scales, 2020; sanctioning proceedings dated 18.12.2023 and further disbursal proceedings in Rc. This Writ Petition is filed under Article 226 of the Constitution of

India by the Petitioners for the following relief:

“to issue an appropriate Writ, Order or Direction, more particularly a Writ in the nature of MANDAMUS declaring the action of Respondents in non-payment of admitted amount of Rs. 19,88,070/- towards sanctioned 300 days of Earned Leave as per the proceedings of 5th Respondent in Procd. No. A1/2117/KRSH/2023 Dt. 18.12.2023 as illegal, arbitrary, violative of Article 21 of the Constitution of India, and consequently direct the Respondents to release the admitted amount of Rs. 19,88,070/- along with 7% interest towards sanctioned 300 days of Earned Leave to the Petitioner expeditiously or to pass….”

Heard the learned counsel for the petitioner and the learned Standing counsel appearing for the respondents.

The present writ petition is filed for non-payment of admitted amount of Rs. 19,88,070/- towards 300 days of earned leave as per the proceedings of Respondent No.5 in Procd. No. A1/2117/KRSH/2023 Dt. 18.12.2023.

The Petitioner herein initially joined the service of the 5th Respondent on 01.02.1984 as a Supervisor. The Petitioner thereafter retired from service on attaining the age of superannuation in the cadre of Deputy Executive Engineer, APSHCL, Jaggaiahpeta Sub-Division,

Krishna District (as it then stood), with effect from 28.02.2023, under the Revised Pay Scales, 2020. It is respectfully submitted that, as on the date of retirement, the 5th Respondent duly sanctioned leave salary equivalent to 300 days of Earned Leave, as per the rates and allowances applicable to the Petitioner, and issued proceedings in Proc. No. A1/2117/KRSH/2023 dated 18.12.2023, directing the 7th Respondent herein to draw and disburse the surrender leave amount equivalent to 300 days of Earned Leave, amounting to Rs.19,88,070/-, forthwith. Pursuant thereto, the 7^th Respondent herein issued further proceedings in Rc. No. 863/A1/2022 dated 07.02.2024, directing the 3rd Respondent herein to disburse the said amount immediately. However, despite issuance of the aforesaid proceedings dated 18.12.2023 and 07.02.2024, and notwithstanding the lapse of nearly two years therefrom, the Respondents herein have failed and neglected to draw and disburse the said sanctioned amount in favour of the Petitioner. Hence, the present writ petition.

The learned Standing Counsel for A.P. Housing Corporation, on instructions, submits that the amount claimed by the Petitioner is not in dispute. The bills were also uploaded in CFMS portal and the payment would be made shortly.

In the light of the submissions made, as there is no dispute about

the amount claimed by the Petitioner, the Writ Petition is disposed of with a direction to the Respondents to disburse the amount within a period of two (2) months from today. There shall be no order as to costs.
