The Court made the following order:

The present Revision Petition is filed aggrieved by non-disposal of I.A.No.353 of 2025 in O.S.No.149 of 2025 on the file of the Court of Civil Judge (Junior Division), Vayalpad.

The case of the Revision Petitioners is that I.A.No.353 of 2025 filed for grant of temporary injunction is not being disposed of and the same is being adjourned from time to time.

The learned counsel for the petitioners inter alia submits that when an application is filed under Order XXXIX Rule 1 of C.P.C., the same shall be disposed of, within a period of 30 days and due to non-disposal of the I.A., the petitioners / plaintiffs are put to irreparable loss and prejudice. The counsel also submits that I.As., are posted to 17.04.2026.

In view of the same, instead of going into merits of the case directing notice, it is deemed appropriate to dispose of the Revision Petition, providing that the learned Trial Court shall dispose of the said I.A., as expeditiously as possible, within a period of four weeks from the date of next posting, in accordance with the Law.

Accordingly, the Revision Petition is disposed of. No costs. Consequently, all pending applications shall stand closed.
