Nagalapuram Police Station, Kurnool District for the offences punishable under Sections 352, 353(1 )(c), 353(2) of the Bharatiya Nyay Sanhita, 2023 and Section 67 of the Information Technology Act, 2000, and direct the respondent police to release the petitioner on bail in the event of his arrest, on such terms and conditions as this Hon'ble Court may deem fit and proper;

The instant Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the Petitioner/Accused seeking anticipatory bail in connection with Crime No.117 of 2025 on the file of K.Nagalapuram Police Station, Kurnool District for the offences under Sections 352, 353(1)(c), 353(2) BNS, 67 ITA-2000-2008.

2. Heard Sri P.Sasidhar Reddy, learned counsel representing Sri Sudharshan Reddy Jalla, learned counsel for the Petitioner and Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State.

Sri P.Sasidhar Reddy, learned counsel representing Sri Sudharshan Reddy Jalla, learned counsel for the Petitioner submits that the offences alleged against the Petitioner are punishable with imprisonment for a period of less than seven years and Police may be directed to follow the procedure contemplated under Section 35(3) of BNSS.

4. Learned Assistant Public Prosecutor submits that the offences registered against the Petitioner are punishable with less than seven years period of imprisonment and necessary direction may be given to the concerned Station House Officer to follow the guidelines of the Hon’ble Apex

5. Learned Counsel for the Petitioner would submit that recording the same, the petition may be disposed of.

6. Considering the submissions, this Criminal petition is disposed of, with

the following;

a. Investigating Officer is at liberty to complete the investigation, in accordance with law.

b. In the event of any coercive action sought to be taken against the Petitioner, concerned police authorities are directed to scrupulously follow the procedure prescribed under Section 35 (3) of BNSS., [Section 41-A Cr.P.C] and the guidelines laid down by the Hon’ble Supreme Court in Arnesh Kumar’s case (supra), which is reiterated in the recent judgment of the Hon’ble Apex Court in Satender Kumar
