JUDGMENT:

Ms. K. Divya Chaitanya, learned counsel representing Sri D. Vamsi Krishna, learned counsel for the appellant, submitted that the appellant is no more and that he died pending the appeal on 26.08.2024. In that regard, a memo dated 06.12.2024 is filed before the Registry along with a copy of the death certificate of the deceased appellant.

Sri S. Syam Sunder Rao, learned Standing Counsel – cum – Special Public Prosecutor for ACB, representing the respondent-State, is in attendance.

In view of the submissions made by the learned counsel representing the appellant and since none of the legal representatives of the deceased appellant had come forward seeking leave to continue the appeal as contemplated under Section 394 of the Code of Criminal Procedure, the appeal stands abated as against the appellant under Section 394 of the Code of Criminal Procedure.
