The appeal has been filed by the husband. His petition seeking divorce under Section 10(1) (ix) (x) of the Indian Divorce Act, was dismissed.

The appeal has been filed with delay of 227 days. I.A.No.1 of 2024 has been filed to condone the said delay.

Learned counsel for the appellant, has submitted a letter dated 02.04.2026, to the Registrar (Judicial), requesting that the appeal be listed under the caption ‘for withdrawal’ as the appellant is inclined to withdraw the appeal.

Sri Kashapogu Suresh, learned counsel for the appellant, is present and submits that the C.M.A. may be dismissed as withdrawn, as the parties intend to settle the dispute amicably by filing an application for divorce by mutual consent.
