Writ Petition under Article 226 - direction to conclude investigation and file final report. Jayavarapu Surya Narayana (petitioner) sought a writ of mandamus directing Respondent No.3, the Station House Officer, Chintalapudi Police Station, West Godavari District, to conduct investigation and enquiry in accordance with the provisions of the criminal procedure and the police manual in FIR No.467/2020 dated 19.07.2020, registered for offences punishable under Section 420 r/w 34 IPC, the grievance being that the respondent-police were not concluding the investigation or filing the final report. The learned Assistant Government Pleader for Home submitted that the Court may pass appropriate orders. Disposing of the writ petition, Dr Justice Venkata Jyothirmai Pratapa directed the police to conclude the investigation and file a report according to law as expeditiously as possible within a period of two (2) months from the date of receipt of a copy of the order, if not already filed by that date. This Writ Petition is filed under Article 226 of Constitution of India with

the following prayer for:

“…to issue an order, direction or writ, more particularly one in the nature of WRIT OF MANDAMUS directing the Respondent No.3 to conduct investigation and enquiry in accordance with the provisions of the criminal procedure and the police manual in FIR No.467/2020 Dt. 19/07/2020 of Chintalapudi PS, West Godavari District and pass .…”

Heard Smt. Nimmagadda Revathi, learned counsel for the petitioner

and Sri V. Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioner would submit that the respondentpolice are not concluding the investigation and filing final report in Crime No.467 of 2020 dated 19.07.2020 on the file of SHO, Chintalapudi Police Station, West Godavari District for the offences punishable under Section 420 r/w 34 IPC. He would further submit that let there be a direction to the respondent police to conclude the investigation and file a report according to law.

Considering the submissions, this Writ Petition is disposed of. However, the police are directed to conclude the investigation and file a report according
