The Writ Petition is filed questioning the inaction of the Respondent No.2 on the representation of the Petitioner dated 30.06.2025 as illegal and arbitrary.

The Petitioner was appointed as Office Subordinate in the Commercial Tax Department in the year 2000. Subsequently, the Petitioner was promoted as Junior Assistant on 28.02.2007 in the year 2018 on acquiring B.A and Type Writing Lower Grade in English, and thereafter the Petitioner was promoted as Sr. Assistant-cum-Assistant Executive Officer.

The grievance of the Petitioner is that from 2018, no promotion was being given, a representation was given by the Petitioner on 01.02.2025 stating the roster system has not been followed in the Department since 2018. It is stated that the Petitioner was placed at 8229 instead of 87.9 As there was no response, the Petitioner gave another representation on 30.06.2025 to the Respondent No. 1. The Respondent No.1, in turn, addressed Memo No. REV01-CCSTOMISC/36/2-25-CT-1, dated 04.07.2025, directing the Chief Commissioner of State Tax

to examine the representation of the petitioner and take necessary action as per the rules. Subsequently, the Chief Commissioner of State Tax addressed another Letter dated 19.07.2025 to the Respondent No. 2 to examine the representation of the Petitioner and take necessary action. In turn, the Respondent No. 2 addressed a Letter dated 12.08.2025 to the Joint Commissioners Nos. 2 and 3 and also the Assistant Commissioners Nos. 1, 2, and 3 Divisions, requesting to send relevant information and records for taking necessary action. As there was no progress in the matter, the present Writ Petition is filed.

Sri S. Raju, learned Assistant Government Pleader, would submit that the action has been initiated on the representations of the Petitioner, and a personal hearing was provided to the Petitioner on 26.11.2025 in the chambers of the Joint Commissioner (ST), Vijayawada, to enable the Petitioner to submit documents or clarifications. It is further stated that as the claim of the Petitioner involves retrospective roster corrections, it requires a comprehensive report from 2000 onwards. It is further stated that the authorities have initiated action on the representations of the Petitioner and sent communication to all

the concerned, including the supporting office, for furnishing of records. The learned Assistant Government Pleader further submits that reasonable time may be granted to the Respondents for passing a comprehensive order on the representations of the Petitioner.

Heard the respective counsel.

In the light of the fact that the Department is taking active action on the representations of the Petitioner, with the consent of both parties, the Writ Petition is disposed of with following directions:

i) The Respondents shall pass appropriate orders regarding

the representations of the Petitioner dated 01.02.2025 and 30.06.2025 as expeditiously as possible, preferably within a period six months from the date of receipt of a copy of this Order.

ii) There shall be no order as to costs.

As a sequel, the miscellaneous applications, if any, shall

stand closed.
