Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ, order or direction more particularly^{oneinthenatureof} WRIT OF MANDAMUS declaring the inaction on the part^{ofrespondents,} in protecting the Government land of Ac 5.20 Cents covered^{bySy.No.137/2of} Burandoddi Village of C. Land Encroachment Act 1905 and offends Articles 14 and 21 of the Constitution of India and consequently direct the respondents to initiate necessary action to protect the aforesaid land by preventing contemplated encroachment and illegal construction by encroachers.

Petition under Section 151 CPC is filed praying that in the circumstances stated in the affidavit filed in support of the writ petition, the High Court may be pleased to direct the respondents to protect the land of Ac 5.20 Cents covered by Sy. Belagal Mandal,^{whichwasconverted} into water pond long back from illegal encroachment by taking necessary effective steps on time by immediately stopping the unauthorized construction being commenced therein by the encroachers, pending disposal of the main Writ Petition.

The present PIL had been filed with a view to highlight^the unauthorized and illegal encroachments by unscrupulous^elements

over a water body in Burandoddi Village of C.Belagal^Mandalin Kurnool District. Pursuant to the notice issued, now a report has been filed by the District Collector, Kurnool, wherein^ithasbeen stated that two residential houses, one partially constructed^Sri Beerappa Swamy Temple and another partially constructed platform for tastalling the statue, has been constructed.

Accordingly, notices are stated to have been issued to the concerned persons who have undertaJken to remove the said structures within a period of two months on their own. In any case. it is submitted that one residential house built by one Smt. B. Rangamma was partly demohshed by the authorities^and the owners on their own suggested that they would remove^the unauthorized structures within a period of two months.

It is stated by learned coimsel for the petitioner^thatthe concerned have already filed petitions before this Court, according to the instructions received from his chent.

We, accordingly, dispose of this petition with a direction that. in the absence of any orders from any Court, in case^{thestructures} are not removed, then appropriate action be taken by the authorities after the expiry of two months. We will leave it open to
