Petition under Article 226 of the Constitution of India is filed praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ or Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the official respondents in not taking any action on the unofficial respondents for laying out unauthorized unapproved layout in an extent of Ac.0.50 cents and raising unautherised construction of building therein in an extent of 129 sq. yards situated in Sr. No. 85/3 of Kovvada Village. Kakinanada Rural Mandal without obtaining permission from the concerned authorities is illegal, arbitrary and violative the provisions of the Panchayat Raj Act and rules framed there under and also offends Articles 14 and 21 of the Constitution of India and consequently direct the official respondents to take appropriate action against the unofficial respondents as per the provisional order in unauthorized layout No. 2/2021 Dt.22.11.2021 issued by the Respondent No.5 for laying out unapproved layout in an extent of Ac.0.50 cents and raising unauthorized construction of building therein in an extent of 129 sq. yards situated in SR. No. 85/3 of Kowada Village, Kakinanada Rural Mandal and conclude the proceedings.
