of the respondents, more particularly Respondent no. 2, in not reissuing the petitioner's Passport bearing No. L2774029 pursuant to the application vide File number VJ2075531222123 dt. 04.07.2023 on the ground of pending criminal case as illegal, arbitrary, unconstitutional and unjust and in violation of Articles 14, 19 and 21 of the Constitution of India and violation of principles of natural Justice and contrary to the provisions of the Passports Act, 1967 and consequently direct the 2*^^ respondent to reissue petitioner's passport bearing No. L2774029 pursuant to the application dt. 04.07.2023 so as to facilitate the travel of petitioner. lA NO: 1 OF 2024 Petition under Section 151 CPC praying that in the^{circumstances} stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to process the application vide File number VJ2075531222123 dt: 04.07.2023 for reissuance of Passport bearing No. L2774029, without reference to the criminal case.

Heard the learned counsel for the petitioner, the learned^Central Government counsel for the respondent Nos.l Ss 2 and^thelearned Assistant Government Pleader for Home for the respondent^Nos.3to5. 2. This Writ Petition is filed questioning the action of the respondent No.2, in not reissuing the petitioner’s passport bearing

NO.L2774029 pursuant to the application vide File

No.VJ2075531222123 dated 04.07.2023 on the ground of pendency of criminal case against the petitioner.

On the other hand, the learned Assistant Government Pleader for Home submits that with respect to the respondent No.3/Police Station is concerned the FIR was registered on 03.07.2020 and the investigation was completed and the charge sheet was filed against the petitioner and it is numbered as 34 of 2021 on the file of the III Additional Metropolitan Magistrate, Vijayawada and^thesaid case IS pending. In so far as the respondent No.4 is concerned, the petitioner is shown as accused No7 in Cr.No.294 of 2020 U/s 151^Cr.P.Candhe was produced before the Mandal Executive Magistrate, Vijayawada and further action was dropped. In so far as, the respondent^No.5 is concerned, the action was dropped against the petitioner in Cr.Nos.l34, 136 of 2020, 134 of 2023 and 11 of 2024.

In view of the above said facts and circumstances, the petitioner is at liberty to approach before the appropriate authorities^concerned for reissuance of the petitioner’s passport and the same shall be duly considered in accordance with law and no further orders are necessary in this Writ Petition.

Accordingly, this Writ Petition is disposed of. No^costs.
