grievance of the petitioner is that though the Chief Executive Officer and the President of the bank are responsible as per report dated 18.01.2014, the petitioner was also held responsible for the misappropriation that took place in the bank. Thereafter, an enquiry officer was appointed on 11.09.2014; who has concluded that three charges out of four charges framed against the petitioner were proved, vide report dated 16.10.2014. Basing on the said report dated 16.10.2014, the 3'"'^ respondent has issued proceedings dated 25.10.2014 seeking explanation from the petitioner and the same has been submitted by the petitioner on 29.10.2014 reiteratinghiscontentions. 5. While the things stood thus, the petitioner has retired from service upon attaining the age of superannuation on 31.10.2014 and was relieved from the services of the bank. However, the petitioner was not paid his retirement benefits. The main grievance of the petitioner is that, despite not paying retirement benefits to the petitioner, the 3'^^ respondent vide the impugned proceedings dated 10.09.2015 has imposed the following punishment on the petitioner: “It is hereby ordered to award punishment of "broughtdowntolowerscalein the cadre of Asst. .Manager besides fixing of financial liability for recovery of Rs.10,61,680/- proportionately with other delinquents. ”
