Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an order, writ or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondents in filling up 15% All-India Quota seats in BVSc and AH Course basing on criteria other than AlPVT 2016 merit list for being illegal, arbitrary, against the provisions of the Indian Veterinary Council Act, 1984 and the Veterinary Council Of India Minimum Standards of Veterinary Education^BVScandAH Degree Course Regulations, 2016, and unconstitutional, and consequently direct the respondents to fill the 15% All India Quota seats in BVSc and AH Course only with candidates from the AlPVT 2016 merit^list

ORDER;

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief;-

“....lo issue an order, writ or direction, more particularly one in the nature of writ of Mandamus, declaring the action of the respondents in filling up 15% All-India Quota seats in BVSc and AH Course basing on criteria other^than AIPVT 2016 merit list for being illegal, arbitrary, against the provisions of the Indian Veterinary Council Act, 1984 and the Veterinary Council Of India Minimum Standards of Veterinary Education BVSc and AH Degree Course Regulations, 2016 and unconstitutional and consequently direct the respondents to fill the 15% All India Quota^seats in BVSc and AH Course only with candidates from the AIPVT2016 merit list...”

When the matter came up for admission on 15.11.2016, this Court passed the following interim^order:

“....this Court is of the view that filling up of the four seats basing upon the State rank is erroneous and contrary^tothe order dated 06.10.2016 in LA.No.9 of 2015 and batch. Hence, the following directions:

a) The third respondent is directed to issue notification for one (1) seat for admission basing upon AIPVT-2016 merit list and complete the e.xercise within one week from today.

b) The scheduled counselling of fourth respondent for^three (3) seats released by second respondent on 09.11.2016 is stayed. The fourth respondent is directed to issue notification for admission of students for three (3) seats basing on AIPVT-2016 forthwith and complete the process of admission within one week from today.

c) Petitioner can also apply and the case of the petitioner is considered basing on the All India merit list and appropriate decision taken.

Learned counsel for the petitioner submitted that i __n pursuance of the interim order dated 15.11.2016 granted by this Court, the cause in the writ petition does not survive.

Recording the above submission, the cause in the writ petition does not survive for further adjudication.

¶42

Accordingly, the Writ Petition is closed. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any,
