Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents 2 to 5 herein in dispensing with the services of the petitioner and not allowing the petitioner to work as Field Assistant in the 5'^ respondent Gram Panchyat, Ozili Mandal, Tirupathi District without issuing any and without assigning any reason as illegal, arbitrary, violation of Principles^{ofNaturalJustice,} contrary to the provisions of Mahatma Gandhi National^Rural Employment Guarantee Scheme Act 2005 and in violation of Article 14 and 21 of the Constitution of India and Consequently direct the respondents 2 to 5 to continue the petitioner as Field Assistant in the 5th respondent Gram Panchayat.

Heard Sri Mrs. Sri Deepthi, learned counsel for the petitioner, Sri M.S.R.Chandra Murthy, learned Standing counsel appearing for respondents 2 and 3, and Smt.B.Aparna Lakshmi, learned Standing counsel for respondents 4 and 5.

Learned counsel for the petitioner would submit that the petitioner was appointed as Field Assistant in Kurugonda Gram Panchayat, Ozili Mandal, tirupathi District on 02.11,2012 and since then he has been discharging his duties. Without issuing any notice or assigning any reasons, the respondents directed the petitioner not to attend the duties.

Sri M.S.R.Chandra Murthy learned standing counsel, on the instructions furnished by Project Director DWMA, Tirupati, would submit that the Project Director, District Water Management, Tirupati, has not issued any oral or written instructions to the respondents 4 and 5 to restrain the petitioner from discharging duties as Field Assistant in Kurugonda Gram Panchayat, Ozili Mandal, Tirupathi District.

Smt.B.Aparna Lakshmi, learned standing counsel submitted that respondents 4 and 5 are not interfering with the petitioner’s discharge of duties as field assistant.

Given the facts and circumstances of the case coupled with the instructions furnished by the Project Director, DWMA, Tirupati, the writ petition is disposed of, at the admission stage with the consent of learned counsel on
