The present writ petition is filed to declare the inaction^onthe part of the respondents in releasing the additional subsidy part of payments for an amount of Rs.32,19,529/(Thirty Two Lakhs Nineteen Thousand Five Hundred and Twenty Nine Only) with regard to supply, installation and grounding of Drip and Sprinkler^Irrigation Systems to 360 farmers in Srikakulam District, despite^thefactthe installation was completed and utilization certificate and other requisite documents were also sent to the respondents for making payments, as illegal, arbitrary and violative of Article 14, 19(1)(g)^{ofConstitutionof} India and consequently direct the respondent authorities^toreleasethe SC Corporation Non-Subsidy part of payments i.e., Rs.32,19,529/-^to the petitioner.

The 4^*^ respondent filed counter admitting that there^isabalance amount of Rs.32,19,529/yet to be remitted by the ED, SC Corporation/Government as a Non-Subsidy to the petitioner company through the Project Director, APMIP, Srikakulam.

The respondents 5 and 7 filed counter contending that no permission has been accorded to the District Collector,^Srikakulamor to the Executive Director, DSCSCS Limited, Srikakulam for implementation of the scheme and assuring release of funds by the respondents 5 and 7 office as per the record maintained.

t 4. As seen from the counters filed by the respondents 4. 5 and 7, they are not disputing the amount payable to the petitioner herein. Therefore, this Court is inclined to dispose of this writ petition directing the respondents to pay the amount of Rs.32,19,529/-,^whichwasdue

to the petitioner, within a period of three months^from the date of receipt of a copy of this order, failing which, the petitioner is entitled interest @ 6% per annum from the date of order till the date of realization.

Accordingly, the Writ Petition is disposed of. There^shallbeno order as to costs.

As a sequel, miscellaneous petitions pending, if any,^shallstand

closed.
