This Second Appeal was filed by the appellant/defendant under Section 100 of the Code of Civil Procedure, 1908 (for short, 'C.P.C.') against the Judgment and decree, dated 24.11.2006 passed in A.S.No.43 of 2005 on the file of learned III Additional District Judge, Kurnool at Nandyal, confirming the

judgment and decree, dated 20.10.2005 passed in O.S.No.23 of 2002 on the file of learned Senior Civil Judge’s Court, Allagadda.
