The present writ petition came to be filed under Article 226 of the Constitution of India seeking the following relief:

“…to declare the action of the 3^rd Respondent in not considering the request of the Petitioner for Empanelment of UPVC Windows of Band names VAJRAM and WINDOORFAB as per Item Codes BMTP79-P.80 in Doors and Windows Section to A.P.Revised Standard as arbitrary, illegal and in violation of the rights guaranteed under Article 14, 19 and 21 of the Constitution of India and consequently direct the 3^rd Respondent to empanel the UPVC windows of Brand names VAJRAM and WINDOORFAB belonging to the Petitioner and to pass…”

The present petition is filed by the Manager of Vajram Polymers, wherein the 1^st respondent through G.O.RT.No.95, dated 18.01.2015, issued by Transport, Roads & Buildings Department has constituted the committee of Chief Engineers for the finalization of the Schedule of Rats (SOR) for both electrical and civil items specific to the function of Building works and that the said committee each year notifies the schedule of rates and for the items involved in electrical and civil items. While so, on 15.07.2022, the said committee notified AP Building SOR 2022-23, the specification of casement/ casement cum fixed glazed windows is provided at serial No.838, item code BMT-P.78. The specification for UPVC fixed glazed

windows/ventilators provide at serial no.869 with item code BMTP.79. The specification for the sliding glazed window is provided at serial no.870 with item code BMT-P.80.

The case of the petitioner is that, their firm is a manufacturer of UPVC Windows, doors and fixed/ventilators of brands WINDOORFAB and VAJRAM and intends to supply their products in Andhra Pradesh State Government works of Andhra Pradesh Medical Services Infrastructure Development Corporation (APMSIDC) for New Constructed Medical Colleges across the State and Panchayat Raj Department for Village Sacchivalayas, RBK’s, Wellness Centers, Bulk Milk Centers, Libraries etc., and the petitioner’s products are meeting the above mentioned standards, as such the petitioner made a representation to Engineer-in-Chief (AW/IW) WR Depot., and Chairman of Board of Committee of Chief Engineers on 21.02.2023.

Through a letter dated 27.02.2023, the Engineer-in-Chief (AW/IW) WR Dept., & Chairman of Board of Committee of Chief Engineers has forwarded their proposal for empanelment and requested to examine and consider their proposal of the brand name in the Buildings SOR. And on 13.03.2023, the petitioner submitted its sample windows and corner cross-sections of cross sections of 3-track and 2-track to the Superintendent Engineer, APMSIDC Circle, Rajamahendravaram and considering the sample windows and

designs recommended to the 3^rd respondent for inclusion of VAJRAM & WINDOORFAB in brand names for UPVC windows.

Enclosing the above two letters on 31.03.2023, the petitioner made a request for empanelment of UPVC windows of Brand name VAJRAM and WINDOORFAB into APSOR as per SOR standards. Pending the said request with the respondents, the petitioner has filed the present writ petition.

Heard the learned counsel for the petitioner and the learned Government Pleader for Roads & Buildings.

In view of the fact that the representation made by the petitioner on 31.03.2023 is still pending with the respondents for consideration, this Court, instead of going into the merits of the case, feels it appropriate to dispose of the writ petition by directing the 3^rd respondent to pass appropriate orders on the representation made by the petitioner dated 31.03.2023, within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, writ petition is disposed of. There shall be no

order as to costs.

Miscellaneous petitions, pending, if any, in this Writ Petition shall stand closed.
