ORDER :

The present Writ Petition came to be filed under Article 226 of the Constitution of India seeking the following relief:-

“to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents 2 to 4 on the spandana representation dated 13.02.2023 made for construction of the culverts in the place of old culverts near Mogalamuru and Tummalapalli Villages, Allavaram Mandal on the R and B Road i.e. Peruru “Y” Junction to Bendamurlanka Village, Allavaram Mandal, Dr. B.R. Ambedkar Konaseema District is illegal, arbitrary and unconstitutional and contrary….”

The case of the petitioners is that they are all having agricultural land in the village. There are Irrigation canals, crossing the R&B Road; on which, pipe culverts were constructed long back. The Government of Andhra Pradesh recently developed the road from Peruru “Y” Junction to Bendamurlanka Village by widening the existing major district-road as State highway and while developing the said road, the respondent Nos.2 & 4 have failed to construct the culverts in place of old culverts which are in dilapidated condition on the irrigation canals.

The further case of the petitioner is that after development of the road, many lorries are plying with more than 50 tonnes of weight,

due to which, culverts have been damaged and because of which the petitioners are not only losing their access to their village, but are also facing irrigation problems. The petitioners further submitted that they, along with other three (3) villagers have made Spandana compliant on 13.02.2023 to the second respondent which was thereafter forwarded to the third respondent. But, in spite of receiving the said Spandana complaint, the respondents have failed to take appropriate action for construction of the culverts and requested this court that a direction may be given to the 2^nd respondent to act upon the compliant of the petitioner.

In view of the same, instead of keeping this writ petition pending, this Court feels it appropriate to dispose of this writ petition, by directing the respondents Nos. 2 to 4 to act upon the petitioners’ Spandana representation made on 31.02.2023. The said action shall be initiated within a period of four (4) weeks from the date of receipt of this order. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall also stand closed.
