The Writ Petition is filed under Article 226 of the Constitution of India seeking to declare the action of the respondent nos.2 to 5 in not taking any action in respect of the encroachments made on R.S.Nos.819, 821, 824, 827 and 828 of Chinnakondepudi Village, Seetanagaram Mandal, East Godavari District by the respondent nos.6 to 9 as illegal, arbitrary and consequently direct the respondent nos.2 to 5 to remove the encroachments made by respondent nos.6 to 9 in respect of R.S.Nos.819, 821, 824, 827 and 828 of Chinnakondepudi Village, Seetanagaram Mandal, East Godavari District.

Heard learned counsel for the petitioners, learned Assistant Government Pleader and learned standing counsel appearing for respondents. 3. Notices were served on R6 to R9 and they made their appearance through an Advocate but on previous two occasions no representation on their behalf.

4^th respondent has filed counter. According to the counter, they have conducted enquiry and the report reveals that as per

village revenue records i.e. A-Register of Chinnakondepudi village,

the land in Sy.No.819 measuring an extent of Ac.1.35cents recorded as Government poramboke i.e. bandidari and according to the Mandal Revenue Inspector’s report, the land is in encroachment cultivating maize crop and the crop is grown above 6 feet height and some of the extent is covered with drain and further submitted that it is not possible to survey exactly for identifying the boundaries of the said land. The said counter was filed on 28.02.2022.

Learned Government Pleader for Revenue has placed latest instructions of the Tahsildar, Seethanagaram Mandal on 04.01.2023. According to the said instructions, changes have been made to A-Register the land with an extent of Ac.1.35cents in Sy.No.819 has subdivided and assigned to Smt. Sunkara Mandamma and Chinnam Aravalu and changes made from bandidari to G.D vide 8A3/88. As far as the remaining extent of land in Sy.No.819, 821, 828, and 827 was surveyed and boundaries were also fixed. Accordingly, notices were served on respondent no.7 and 6 and evicted encroachments.

Considering the said instructions, as the respondents have already initiated and taken action against the encroachments, no further orders are required in this writ petition.

It is needless to mention that if any further encroachments

are there in the subject property, the petitioners are at liberty to bring it to the notice of the concerned authorities by way of a complaint and if any such complaints are received, the respondents are directed to take necessary action as per rules.

Accordingly, the writ petition is closed. No costs.

As a sequel miscellaneous applications, pending, if any, shall also stand closed.
