This writ petition, under Article 226 of the Constitution

of India, is filed seeking the following relief/s:

“… pleased to issue a writ order or direction

more particularly one in nature of Writ of Mandamus declaring the inaction on the part of the respondents in paying bills to the petitioner an amount of Rs.81,00,000/- (Rupees Eighty One Lakhs only) to the petitioner for the works executed by the petitioner under Package No APAM/Annamayya/Rajampet/04, Consisting of 02 road works in Rajampeta Constituency (1) BT repairs to Road from Narasannagaripalli Ele. School to Gangaperur Mitta of Vontimitta Mandal in Annamaiah District, est. Cost of Rs.51,00,000/(Rupees Fifty One Lakhs) (2) BT Repairs to road from CRA road at 30/0 km to Polubuchaiahgaripalli of Vontimitta Mandal in Annamaiah District Est. cost of Rs.30,00,000/(Rupees Thirty Lakhs only) total Package Est.Cost of Rs.81,00,000/- (Rupees Eighty One Lakhs) vide Agreement No.ni1/2022-23 dated 24.06.2022 for an amount of Rs.81,00,000/- (Rupees Eighty One Lakhs) as arbitrary, illegal, contrary to the settled legal position apart from being voilative of fundamental rights guaranteed to the petitioner

Heard Sri N.Ramesh, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj & Rural Development appearing for respondent Nos.1, 5 to 9, learned Assistant Government Pleader for Agriculture and Cooperation (Marketing-II) Department appearing for respondent No.2 and learned Assistant Government Pleader

for Finance & Planning Department appearing for respondent Nos.3 & 4,

Learned Assistant Government Pleader for Panchayat Raj & Rural Development, on written instructions dated 14.09.2023, submitted that the authorities are ready and willing to pay the net amount payable to the petitioner but they are waiting for fund clearance and sought three (03) months’ time for payment.

To the said submission, learned counsel for the petitioner reported no objection.

Taking into consideration the submissions of both the learned counsel for the petitioner as well as learned Assistant Government Pleader for respondents, as the authority intends to pay the amounts, there is no purpose in keeping the Writ Petition pending. As such, this Court is inclined to dispose of the Writ Petition, at the admission stage, with the consent of both the learned counsel, by passing the following order:

The concerned respondent-authority is here by directed to release the admitted/legally entitled amount to the

petitioner within a period of three (03) months’ from the date

of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall

be no order as to costs.
