ORDER:

The present Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“…..issue an order, writ or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents in withholding the payment of final bill amount of Rs.4,49,106/- in respect of work, even after finalizing the bills payable to the petitioner for the year 2019 as illegal, arbitrary and in violation of Article 14 of Constitution of India and consequently direct the respondents to pay the final bill amount of Rs.4,49,106/- to the petitioner.…..”

Heard Sri Pullagura Nagaraju, learned counsel for the petitioner, learned Assistant Government Pleaders for Panchayat Raj and Rural Development and for Finance & Planning and Sri G. Venkata Reddy, learned Standing Counsel for Gram Panchayat.

The learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions dated 04.07.2023 submitted that the authorities have admitted the amount claimed by the petitioner and sought time for payment.

The learned Assistant Government Pleader for Finance & Planning

sought six (06) weeks time for payment of the amount.

To the said submission, learned counsel for the petitioner

reported no objection.

Taking into consideration the submissions of learned counsel for

both sides, this Writ Petition is disposed of, at the admission stage.

¶18

Accordingly, the respondents are directed to release the

¶19

admitted/ legally entitled net amount to the petitioner at the earliest, and at any rate, within a period of six (06) weeks from the date of receipt of

copy of this order. There shall be no order as to costs.

¶21

As sequel thereto, miscellaneous petition, if any, pending shall stand closed. Interim orders, if any, shall stand vacated.
