JUDGMENT:
VVhen the matter is taken up for hearing, Sri T. Vijay Hanuman Singh, learned counsel for the appellant, submits that he was instructed by one Syed Saleem, G.P.A. of Smt. Sayed Bibi Saleema Sahib, who is the appellant herein, to withdraw the case, vide letter dated 11.07.2023 wherein it is mentioned that the matter was compromised between both the parties on 20.05.2023. He further submits that as per the terms of compromise entered into between both the parties, a compound wall was also constructed. He, therefore, prays that he may be permitted to withdraw the case.
Permission is accorded, and accordingly, the Second Appeal is dismissed as withdrawn. No order as to costs.
The Registry is directed to keep the withdrawal letter dated 11.07.2023 along with the record.
As a sequel thereto, miscellaneous petitions, if any pending,
shall stand closed.
