That the Appeal be and is hereby disposed of in terms of the compromise. 2. That the I.A No.1 of 2023 which was filed to record the compromise between the appellants and respondents be and is hereby ordered.

'It is submitted that respondents 1 to 3 herein filed O.S.No.202 of 2004 on the file of the.;.court of the Senior Civil Judge, Nandyal for partition and separate possession of their 314th share in the Plaint/Memorandum of Compromise Schedule Properties and also for mesne profits. It is submitted that after full pledged trial; the learned Senior Civil Judge, Nandval_ was pleased to pass a preliminary decree on 05.10.2007 in O.S.No.202 of 2004. As per the preliminary decree the respondents 1 to 3 herein are entitled to 3!4`1' share and the appellant is entitled to 1/4th share in the Plaint/Memorandum of Compromise Schedule Properties.

It is submitted that aggrieved by the preliminary decree and Judgment dated 05.10.2007, the Appellant herein filed Appeal A.S.No.571 of 2007 on the file of

this Hon'ble Court and this Hon'ble Court was pleased to grant interim order of stay of passing of final decree alone by directing to proceed for division of properties in A.S.M.P.No.2234 of 2007 dated 30.10.2007. It is submitted that the respondents herein filed I.A.No.706 of 2007 seeking to appoint Advocate Commissioner to inspect the Plaint/Memorandum of Compromise Schedule Properties and divide item Nos.2 to 4 into .four (4) equal shares . and submit his report with plans and measurements. It is submitted that the learned Senior Civil Judge, Nandyal was pleased to allow I.A.No.706 of 2007 and appointed Advocate Commissioner and accordingly the Advocate Commissioner submitted his report along with plans.

It is submitted that the appeal filed by the appellant A.S.No.571 of 2007 on the file of this Hon'ble Court is pending for final hearing. It is submitted that the appellant and respondents are own brother and sisters and on the intervention of elders the dispute is settled between the parties amicably. According to the said settlement the appellant agreed to pay Rs.5.00,000/- each to respondents 1 to 3 towards their share in the Plaint/Memorandum of Compromise Schedule Properties and the respondents 1 to 3 agreed to receive the same. The terms of compromise are as follows:

Aggrieved of the judgment and decree dated 05.10.2007 passed in O.S.No.202 of 2004 on the file of Principal Senior Civil Judge, Nandyal, the appellant/defendant had filed this appeal. 2. During the pendency of this appeal, the parties had entered into compromise and had settled the matter out of Court and moved I.A.No.1 of 2023 requesting to dispose of the appeal in terms of the compromise. The terms of the compromise are reduced into writing by way of a Memorandum of Compromise and the same is placed on record.

Both the parties are present before this Court. They also produced proofs in regard to their identity. The parties are duly represented by their respective counsel.

The learned counsel for both the parties had submitted that since the parties have settled the matter out of Court and had entered into compromise, the main appeal be disposed of in terms of the compromise memo.
