ORDER:
The present writ petition is filed declaring the inaction of official respondents in taking any action against the 7th respondent for misusage of public water plant for commercial purpose and further inaction of the official respondents in acting on the representation dated 04.10.2021, as illegal, arbitrary and violative of G.O.Ms.No.127 dated 30.08.2014.
Heard the learned counsel for the petitioner, learned Assistant Government Pleader for Panchayat Raj appearing for respondent Nos.1 to 4 and Sri I.Koti Reddy learned Standing Counsel for Gram Panchayat appearing for respondent Nos.5 and 6.
Learned counsel for the petitioner submits that the petitioner is a resident of the 6th respondent-Gram Panchayat. Pursuant to G.O.Ms.No.127 dated 30.08.2014, a water plant was established in the Gram Panchayat under the scheme of ‘NTR Sujala Pathakam’. As per the said G.O., the water plant should be for public purpose and the water should be sell at the rate of Rs.2/- per can only. The 6th respondent-Gram Panchayat passed a resolution to handover the said water plant to the 7th respondent for running of the same in accordance with the scheme only. He further submits that the 7th respondent in violation of the scheme is selling the water cans in commercial way by that violated the guidelines of the scheme. Hence, he pleaded that the 6th respondent shall take steps to run the water plant as per the guidelines of the scheme.

By order dated 16.06.2022, this Court observed that learned Standing Counsel for Gram Panchayat, on instructions, submitted that the Gram Panchayat passed resolution for taking over the plant from the 7th respondent.
Learned counsel for the petitioner also admitted that the plant, which is in possession of the 7th respondent, was taken over by the 6th respondent-Gram Panchayat as prayed in this writ petition.
In view of the action of the 6th respondent as stated above, the water plant is running by the Gram Panchayat as prayed by the petitioner. Therefore, no further orders are necessary in this writ petition.
Accordingly, the Writ Petition is closed. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
