ORDER

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

“…to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not deleting the word ‘Cheruvu’ from Revenue Records maintained by them in respect of petitioner landed and house site property situated in demarcation or Sy. No.134 bearing Door No.770 in the 11^th Ward in Mangalagiri Town, Guntur district and in not sanctioning layout in respect of the said property and in trying to interfere with petitioner peaceful possession and enjoyment of the said property by removing the stones erected on 4 corners of the site as arbitrary, illegal, unlawful and violative of Article 14, 21 & 300-A of the Constitution of India and consequently direct the respondents to delete the word ‘Cheruvu’ from the revenue records of the respondents in respect of petitioner’s property in demarcation or Sy. No.134 bearing Door No.770 in the 11^th Ward in Mangalagiri Town, Guntur District, direct the respondents to sanction layout in respect of petitioner’s said property and not to interfere with petitioner’s peaceful possession and enjoyment of the said property..”

When the matter came up for hearing, learned

counsel for the petitioner reiterated the contentions urged in the petition.

For considering the present case it would be relevant to refer to Section 15(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989, which is as under:

“Every application for the rectification of an entry in a Record of Rights made under sub-section (3) of Section 3 of the Act shall be to the Mandal Revenue Officer of the Mandal in which the village is situated.”

On perusal of the material available on record, this Court feels it appropriate to dispose of the writ petition giving liberty to the petitioner to make an application under Section 15(1) of the Andhra Pradesh Rights in Land and Pattadar Pass Books Rules, 1989, if at all the said entries are not rectified in the record of rights within a period of four (4) weeks from the date of receipt of a copy of this order.

Accordingly, with the above direction, this writ

petition is disposed of. There shall be no order as to costs.

Consequently, miscellaneous petitions, pending if any, shall stand closed.
