WRIT PETITION No.39439 of 2022

ORDER:

The petitioner has approached this Court with the complaint that respondents 4 to 6, at the behest of respondents 7 to 9, are interfering in a civil dispute between the petitioner and respondents 7 to 9, over an extent of Ac.3.00 cents of land in Sy.No.302/2, situated at Nenam Village, Kakinada Rural Mandal and Village, East Godavari District.

The petitioner contends that said action of

respondents 4 to 6, in interfering in the said dispute is clearly arbitrary, highhanded and violative of Articles 14, 19 and 21 of the Constitution of India.

The learned Assistant Government Pleader had obtained written instructions, given by respondent No.6. In these written instructions, it is stated that on 17.11.2022, respondent No.6 had received a call, complaining of an altercation in Sy.No.302/2. Respondent No.6 after making entry in the general diary had proceeded to the spot specified into two groups, between whom the altercation was taking place. Respondent No.6 further states that enquiries in relation to the altercation had revealed that there were civil disputes with the

said land. On this basis, respondent No.6 is said to have advised both sides, to settle their disputes, by going to the civil Court and thereafter, no further action was taken against any person in this regard.

Recording the same, this Writ Petition is disposed of with liberty to the petitioner to approach this Court in the event of any future difficulty. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
