The present writ petition came to be filed questioning the highhanded action of the respondents in dispossessing the petitioners from the lands situated in Survey No.213(A) of D.Kesavaram Village, D.Kesavaram Grampanchayat, Mandapeta Mandal, East Godavari District, in which the petitioners claimed to be in possession since more than 70 years.

By an order dated 18.12.2009, this Court directed both the parties to maintain status quo for a period of eight (08) weeks, which was extended subsequently.

At the time when the matter is taken up for hearing, Sri Y.Sudhakar, learned counsel for the petitioners submits that a representation was also made by the petitioners to the District Collector for assignment of lands and the same is pending consideration. It is further stated across the bar that the lands, which are subject matter of the dispute and in which the petitioners are in possession, are government lands.

Having regard to the facts in issue, it is made clear that any action to be taken by the respondents for dispossession/eviction of the petitioners from the subject lands, shall only be in accordance with law, provided, the petitioners are still in possession of the same. Further, the representation said to have been made by the petitioners for assignment of lands may also be dealt with in accordance with law, if not already considered. If the said representation is not available with

the respondents, the petitioners are directed to make fresh representation.

With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.
