“5. The Petitioner suppressed the real facts and got filed the Writ Petition before the Honourable High Court of Judicature. All the above facts revealed by the documents filed by the Petitioner itself, which are filed with the application for approved Plan submitted before the Gram Panchayat. The intention of Gram Panchayat, S.Atchutapuram in the letter dated 18.03.2009 is that the Petitioner is the original owner of the entire property including the disputed property till 1971 and the Petitioner lost his right as and when the Petitioner and his family members executed a Sale Deed in favor of Thute Subbayyamma for an extent of Ac.1.00 cents in Sy. No.154, on 09.06.1971. Thus, the subject matter of the disputed property is the part and parcel of the sale deed dated 09.06.1971 executed for an extent of Ac.1.00, which is in favor of Thute Subbayyamma, in which the Petitioners have no manner of right and Thute Subbayyamma also lost her right as she left the disputed property as road, by showing in the sale deed executed by her.
