ORDER:

The Writ Petition is filed to declare the action of respondents in withholding the part payment of amounts even after finalizing bill, payable to the petitioner in relation to the execution of work i.e., levelling of site and formation of gravel roads in S.Nos.232, 325 and

326 to an extent of Ac.40.38 cents in Kondlapudi Village, Nellore Rural Mandal under “Navarathnalu Pedalandariki Illu” as illegal, arbitrary and contrary to the principles of natural justice.

Heard learned counsel for the petitioner, learned Government Pleaders for Municipal Administration & Urban Development, Finance & Planning appearing for the respondent Nos.1 and 7 respectively and Mr.M.Koteswara Rao, learned Standing Counsel for APTIDCO appearing for the respondent Nos.2, 4 to 6. With their consent, the Writ Petition is being disposed of at the admissions stage.

It is the case of the petitioner that he was entrusted with the work of levelling of site and formation of gravel roads in S.Nos.232, 325 and 326 to an extent of Ac.40.38 cents in Kondlapudi Village, Nellore Rural Mandal, and completed the execution of the work as within the stipulated period of contract and claimed the bill amount. The respondents having been satisfied with the execution of work, prepared the bills, but the amount was not paid, for various reasons. Learned counsel further relies on the Order dated 23.10.2019 in Writ Petition No.16315 of 2019 passed in similar circumstances and requests for passing order on the same lines.

During hearing, the learned Standing Counsel for APTIDCO, submits that the bill will be cleared, soon after release of amount.

Considering the submissions made by the learned counsel for the petitioner and the respondents and perusing the Order dated 23.10.2019 in Writ Petition No.16315 of 2019, this Court, without going into merits of the case, deems it appropriate to dispose of the Writ Petition, with a direction to the respondents to clear the bill amount within two months from today, failing which the bill amount will carry interest @ 12% per annum, till the actual payment of the amount to the petitioner.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
